AI Music Ownership Explained: Copyright, Licenses, And Release Rules

Short answer: “You can use this track” and “you own the copyright” are different claims. The U.S. Copyright Office says material generated entirely by AI is not copyrightable, prompts alone do not make you the author, and only human-authored parts of a mixed work can be protected. A service can still give you a contract license, ownership promise, or commercial-use permission. Check both before releasing music.

What Ownership Means For An AI Track

Evaluate three separate rights:

  • Copyright protection: In the United States, entirely AI-generated output is not copyrightable. Your original lyrics, arrangement, recording, edits, or other human-authored additions may be protectable. If an application contains more than a minimal amount of AI-generated material, the Copyright Office says applicants must disclose it and describe the human contribution. Read the Copyright Office report.
  • Contract rights: A platform may grant a commercial license, assign its claims, or say you own the output. Those terms can depend on the plan active when you generated or downloaded the track.
  • Third-party identity and source rights: Voice cloning, covers, uploaded audio, lyrics, and samples can involve other people’s rights. Obtain the required consent and follow the platform’s terms. Spotify says vocal impersonation is allowed only when the impersonated artist has authorized it, and it supports AI disclosures in credits. Spotify’s September 2025 policy announcement describes those protections.

Ownership And Commercial Terms By Platform

The wording below is deliberately narrow: it reports each service’s stated position rather than treating a license as copyright ownership.

Suno Paid subscribers’ created songs are theirs to keep and use; Suno also advertises full commercial rights on Pro. The Free Plan does not include commercial rights. Pro limits downloads to 20 songs per month; verify the plan terms before release.
Eleven Music Tracks are cleared for broad commercial use, with commercial rights varying by subscription tier. The free plan is personal use; commercial rights exclude film, TV, and studio games according to the listed limitation. Check the exact tier.
Loudly Loudly describes its generated music as royalty-free with a commercial license included. Paid licensing rights depend on plan terms, and the free generator limits tracks to 30 seconds.
Mureka Mureka advertises royalty-free downloads and full commercial rights across platforms and projects. Confirm the applicable plan and license for the specific download.
Musicful A downloaded track receives a non-exclusive perpetual license; Musicful retains ownership of generated tracks. It says commercially used tracks are allowed on Standard/Pro plans. Free/Basic use is non-commercial. A license is permission to use, not a transfer of ownership.
CreateSong AI Downloads and commercial use follow the plan active at generation time. Commercial rights apply to generations made on annual plans. Free outputs are streaming-only and public by default; monthly plans are personal and non-commercial.
Songin.ai Music made on a paid plan is advertised for commercial use, including YouTube, Spotify, ads, and games. Free downloads are watermarked MP3 files for personal use; multitrack stems require Premium.
Tunee Tunee says generated songs and videos belong to you and include a full commercial license. Free users may use music only for personal projects with attribution. Tunee says copyright law is evolving and gives no absolute protection guarantee.
Sunp Paid plans are the route for commercial publishing, certificate access, and repeatable project use under its current license agreement. Review the rights before a track leaves the workspace; free use has public songs, streaming-only playback, and no downloads.
OpenMusic AI OpenMusic says every generated track is royalty-free, commercially cleared, and supplied with a license for proof. Plan terms govern downloads and commercial licensing; access is web-only.
AI Game Music Generator It says songs are owned by aigamemusic and offers MP3/WAV downloads with a commercial license. That ownership statement does not establish that you own copyright. Review the license before shipping a game.
AI Makes Song Paid plans unlock commercial rights for videos, podcasts, and games. Free users can test and publish only with attribution.

How To Build A Defensible Release Workflow

  1. Define the release use first. Write down whether the track is for a personal prototype, a monetized video, a podcast, a game, an advertisement, or a streaming release. The same generation can have different plan requirements.
  2. Choose the qualifying plan before generation. CreateSong AI ties commercial rights to the plan active at generation time, while several other services distinguish free and paid use. Save the pricing and license page URL with your project record.
  3. Keep a creation log. Record the prompt, supplied lyrics, uploaded references, model or platform, generation date, plan, downloaded file, and every human edit. This documents your contribution if you later register the work.
  4. Add human authorship deliberately. Write or substantially revise lyrics, compose an original melody, arrange sections, perform parts, or edit the recording. The Copyright Office’s position concerns what you authored, so identify those parts accurately.
  5. Clear voices and source material. Get consent for a person’s voice and permission for uploaded recordings, lyrics, or samples. Do not present an identifiable artist’s voice as theirs without authorization.
  6. Check the destination’s disclosure rules. Spotify supports DDEX AI disclosures and AI Persona badges for identities that may be AI-generated. YouTube requires disclosure of realistic altered or synthetic content that could be mistaken for a real person’s performance. Spotify’s AI Persona announcement and YouTube’s clarified guidance explain those labels.
  7. Archive proof before publishing. Keep the downloaded audio, stems, invoices, license certificate where offered, plan snapshot, and consent records together. Recheck terms if you regenerate, upgrade, or change the release format.

Prompt And Editing Practices That Preserve Your Contribution

For a game cue, start with a functional brief such as “loopable tense exploration underscore, restrained percussion, no recognizable artist imitation.” For a podcast, specify the intro length and where the spoken voice must remain clear. For a video, describe the edit points, energy changes, and instruments that should stay out of the dialogue range. These prompts guide production; they do not by themselves create copyright ownership.

Use the platform’s editing, remix, extension, stem, or MIDI tools only when your plan permits the resulting download and intended use. Export the stems or MIDI when available, then make clearly human-authored changes in your DAW: rewrite a section, replace a drum pattern, record an instrument, or edit timing to picture. Keep the original generation beside the revised version so the human contribution is identifiable.

Common Ownership Mistakes

  • Calling a commercial license “copyright ownership.” Musicful explicitly retains ownership while granting a non-exclusive perpetual license.
  • Generating on a free tier and upgrading later, without checking whether the earlier generation qualifies. CreateSong AI ties rights to the active plan at generation time.
  • Assuming a paid plan clears a cloned or imitated voice. Consent for the person and compliance with the destination platform remain separate checks.
  • Registering the entire output as human-authored. Disclose more-than-minimal AI material and describe the human-authored parts as required by the Copyright Office.
  • Uploading large batches of near-duplicate tracks. Spotify says it uses a music spam filter and removed more than 75 million spammy tracks in the previous 12 months. See the policy report.

What To Put In Your Project README

For a technical music project, add a short rights record next to the audio assets:

  • Platform, plan, generation date, and license URL.
  • Prompt and any supplied lyrics, references, voices, or samples.
  • Human-authored edits and which final files contain them.
  • Required attribution or AI disclosure for each publishing destination.
  • Consent records for voices and permission records for uploaded material.

This makes the release auditable without claiming that a platform license changes the underlying copyright position.
