Protect an AI music release by keeping a dated record of your human contributions, using only material you have permission to use, checking the generator’s terms for the intended use, and completing any required platform disclosures. AI-generated audio alone may not qualify for copyright protection in the United States; your own lyrics, arrangement, edits, and other human-authored contributions may matter, so preserve them separately.
What Can You Protect In An AI Music Release?
The U.S. Copyright Office says material generated entirely by AI is not copyrightable, and prompts alone do not make a person the author. For a mixed work, only the human-authored parts may be protected. If you register a work containing more than a minimal amount of AI-generated material, the Office says to disclose that material and describe the human author’s contribution. Read the U.S. Copyright Office’s AI report and registration guidance.
In practice, keep the project materials that show what you wrote, selected, arranged, or changed. A prompt is useful evidence of process, but do not treat it as proof that you own the generated recording or as a substitute for checking applicable terms.
Build A Rights Record Before Generating
- Write down the intended release. Record whether the track is for a personal demo, a monetized video, a client project, or a commercial release. That use determines which vendor terms you need to check.
- Separate your material from reference material. Save your original lyrics, melody, arrangement notes, and prompt in a dated project file. For any uploaded audio, lyrics, or voice reference, identify its creator and confirm you have permission for the use you plan to make of it.
- Avoid instructions to imitate an identifiable artist or use an unapproved voice. Use descriptive musical traits instead, such as tempo, instrumentation, mood, or structure. Spotify says vocal impersonation is allowed only when the impersonated artist has authorized it. Spotify’s announced AI protections.
- Choose a tool whose stated terms fit the release. Read the current vendor terms and plan details for commercial use, attribution, and any restrictions on references or generated voices. The summaries below flag known limits; they do not establish rights beyond those terms.
Choose A Generator With Clear Limits For Your Use
| Tool | What The Available Terms Establish | Practical Check |
|---|---|---|
| Suno | The Free Plan does not include commercial rights. Its available product information identifies editing, remixing, extensions, section replacement, and stem export; stem separation is not included on the Free Plan. | For a commercial release, confirm the applicable paid-plan rights and terms before generating or publishing. |
| Eleven Music | The Free plan is limited to personal use. Commercial rights vary by plan, and the listed limitations exclude film, TV, and studio games. | Check the plan-specific rights and the excluded-use language for your project. |
| Musicful | Commercial use is limited to Standard/Pro plans; Free/Basic is non-commercial. | Verify the current plan terms and the intended release use before exporting for publication. |
| MiniMax Audio | Its general service terms do not permit commercial use. | Do not assume a paid plan changes this; check the service terms for any update before using it commercially. |
| Ksumiyo | Commercial-use support is listed, but the available details do not specify its conditions. | Read the vendor’s current terms to establish what commercial use permits and requires. |
Generate And Preserve A Human Contribution
- Start with material you authored. Draft your own lyrics, melodic idea, or arrangement brief before prompting. Keep the source file and a dated copy of the prompt.
- Describe musical properties, not a person to imitate. For example: “mid-tempo electronic instrumental, restrained percussion, warm bass, and a clear verse-to-chorus lift.” This is a prompt-writing example, not a claim about a specific tool’s supported genres or controls; check the vendor’s interface for available options.
- Make and save deliberate edits. If you revise lyrics, rearrange sections, or edit audio, save the before-and-after versions and note what you changed. Do not rely on a generated track alone to demonstrate those contributions.
- Keep the project record together. Store the prompt, original lyrics or notes, dated exports, edit history, and the plan terms you relied on in one project folder. If you use a tool’s stems or editing features, save those outputs with the same record; availability depends on the product and plan.
Check Disclosure And Upload Rules Before Publishing
Spotify announced support for DDEX AI disclosures in credits and said its music spam filter targets mass uploads and duplicates. Its announcement also said it had removed more than 75 million spammy tracks in the previous 12 months. Treat accurate credits and distinct, reviewed releases as part of your publishing workflow; check your distributor’s current metadata process for how to supply any AI disclosure. YouTube requires creators to disclose realistic altered or synthetic content that could be mistaken for a real person’s performance, using its altered-or-synthetic content label. Its inauthentic-content policy addresses mass-produced, repetitive, or template-based uploads; the cited clarification describes the policy as targeting those patterns rather than AI use by itself. Check the current upload flow and policy for your specific video. YouTube policy clarification.
For voices, covers, samples, and commercial use, obtain consent or permission where needed and check both the generator’s current terms and the publishing platform’s rules. Do not infer permission to use a recognizable voice, an existing song, or an uploaded sample from a tool’s ability to generate or transform audio.
