Is AI Music Copyright-Free? Copyright, Licenses, and Creator Checks

No—not automatically. “Copyright-free” can mean that a track has no copyright, that you have permission to use it, or that you owe no royalties. Those are different things. In the United States, the Copyright Office says music generated entirely by AI is not copyrightable, prompts alone do not make you its author, and only the human-authored parts of a mixed work may be protected. A platform may still give you a license to use a track, but that license does not by itself establish that you own copyright in the AI-generated music.

What “Copyright-Free” Means For A Track

For a developer shipping a game soundtrack or a creator adding music to a video, the practical question is usually whether the platform’s terms let you use the track in that project. “Royalty-free” generally describes a usage arrangement; it does not necessarily mean the music has no copyright or that you own it. Read the actual license for the track and plan you used, including restrictions on distribution and commercial use.

Copyright status and permission are separate checks. The U.S. Copyright Office also says applicants registering a work that contains more than a minimal amount of AI-generated material must disclose it and describe the human author’s contribution. The cited guidance is about U.S. copyright; it does not settle the rules in every country.

How To Check A Track Before Publishing

  1. Choose the use case first. Write down whether the music is for a monetized video, a game build, a client project, a streaming release, or personal use. A permission statement for one context may not cover another.
  2. Check the terms for the account and plan that generated or downloaded it. Look for commercial-use permission, required attribution, download conditions, and any limits for your intended distribution. A vendor’s broad marketing claim does not replace its applicable terms.
  3. Keep the evidence. Save the track, the applicable terms or license, and any license certificate the service provides. Record the account or plan used and when you obtained the track so you can identify which terms you relied on.
  4. Review human contributions separately. If you wrote lyrics, composed or arranged music, or added other original material, keep those parts identifiable. The Copyright Office says only human-authored parts of a mixed work may be protected; prompting alone does not make you the author of AI-generated output.
  5. Check for recognizable voices, covers, and borrowed material. Do not treat a generated sound-alike voice, cover, or reference upload as cleared just because the output is AI-generated. Get consent where needed and check the platform’s terms for the particular voice, source audio, and use.
  6. Check the destination’s upload rules. YouTube requires disclosure for realistic altered or synthetic content that could be mistaken for a real person’s performance. Spotify says vocal impersonation is allowed only when the impersonated artist has authorized it, and supports AI disclosures in credits.

These statements describe vendor claims or plan notes, not a general guarantee that a track is copyrightable or risk-free. Check each service’s current terms for the exact track, account, and use before publishing.

Service What The Supplied Rights Information Says Practical Check
Suno Tracks made as a paid subscriber are described as yours to use, including in videos and albums. The Free Plan does not include commercial rights. Confirm the plan used when creating the track and its terms.
Eleven Music Tracks are described as cleared for broad commercial use, but rights vary by subscription tier. The Free plan is for personal use; commercial rights exclude film, TV, and studio games. Check the subscription tier and whether the project falls within an exclusion.
Loudly Described as creating royalty-free, commercially licensed music. The stated limitation is that paid licensing rights depend on plan terms. Read the terms for the plan and project before using a track commercially.
Mureka Tracks are described as royalty-free, with full commercial rights across platforms and projects. Verify the applicable terms for your account and download.
Musicful The service says it retains ownership of generated tracks and grants a non-exclusive, perpetual license on download. It also describes commercial use and a commercial license certificate. Keep the certificate and check the plan restrictions; Free/Basic use is non-commercial.
OpenMusic AI Tracks are described as royalty-free and cleared for commercial use, with a license for each song. Plan terms govern downloads and commercial licensing. Save the song’s license and confirm the applicable plan terms.
Songin.ai Paid-plan music is described as available for commercial use. Free downloads are watermarked MP3s for personal use only. Check whether the track was generated and downloaded under a paid plan.
Tunee The service describes paid tracks as having commercial rights and free music as usable for personal projects with attribution. It also says copyright protection is not guaranteed. Confirm the plan and attribution requirement, and do not assume the license guarantees copyright ownership.
Sunp Commercial use is described for paid plans; paid plans are the stated route for commercial publishing under its current License Agreement. Read that agreement for your planned distribution.
SimpleLofi The service describes its beats as copyright-free and safe for monetization on major platforms. Check the vendor’s current terms for the exact project and track.
AI Game Music Generator Tracks are described as downloadable in MP3 or WAV with a commercial license. The supplied signup information says songs are owned by the service. Check the license and ownership terms before including a track in a shipped game.
AI Makes Song Free users may publish with attribution; paid plans are described as unlocking commercial rights for videos, podcasts, and games. Confirm the required attribution or paid-plan terms for your use.

Prompt And Production Workflow For A Usable Track

Describe the musical job instead of relying on a broad prompt such as “make a copyright-free song.” For example, a game developer might specify: “Instrumental background loop for a puzzle game menu; calm, low-density electronic texture; no vocals; clear ending that can loop cleanly.” A video creator might specify: “Short instrumental bed under spoken narration; restrained percussion; no vocals; leave space in the midrange.” These are prompt-writing examples, not claims that every service supports looping, duration controls, or those genres.

Generate a draft, listen for recognizable vocal likenesses or borrowed material, then make any human-written or performed additions in a way you can document. Before exporting or publishing, check that service’s current terms for the use, plan, and distribution you intend. If a needed control, file format, genre, or workflow is not stated by the vendor, verify it on the vendor’s site rather than assuming it is available.

When Platform Rules Also Matter

A usable license does not guarantee monetization or acceptance by a destination platform. YouTube’s inauthentic-content policy targets mass-produced, repetitive, or template-based uploads; the policy is not a ban on AI use as such. Spotify has announced measures addressing vocal impersonation, spam uploads, and AI disclosures in credits. Treat these as separate destination rules to check alongside the music service’s license.

For registration in the United States, disclose more than a minimal amount of AI-generated material and describe the human contribution, as the Copyright Office requires. Keep the track’s license and your own contribution records together so you can answer both questions: what use the platform permitted, and which parts of the work you created.
