Is Making AI Music Illegal? Copyright, Consent, And Platform Rules

Making AI music is generally not illegal. The legal risk comes from what you put into the system, whose identity or recording you imitate, the rights granted by the service, and where you publish the result. In the United States, the Copyright Office says a work generated entirely by AI is not copyrightable; prompts alone do not make you the author, while human-authored contributions to a mixed work may be protected. Registration applicants must disclose more-than-minimal AI material and describe their human contribution. U.S. Copyright Office guidance

What “Illegal” Usually Means In Practice

AI music can create several separate rights problems. A song may be lawful to generate but unlawful to release if it contains an unauthorized vocal imitation, copied lyrics, an uncleared sample, or a license that excludes your use. Copyrightability and permission are different questions: a track can lack copyright protection and still infringe someone else’s rights.

  • Output ownership: Entirely AI-generated passages may not receive U.S. copyright protection. Your lyrics, arrangement, performance, editing, or other human-authored material can be treated differently.
  • Inputs: Upload only recordings, lyrics, or reference audio you are allowed to use. A platform’s upload feature does not give you permission to copy a third party’s material.
  • Identity and voice: Do not clone or imitate a recognizable person’s voice without that person’s authorization. Spotify says vocal impersonation is allowed only when the impersonated artist has authorized it. Spotify’s September 2025 AI-music policy announcement
  • Distribution: Stores can reject spam, duplicates, undisclosed synthetic performances, or releases that violate their terms even when generating the audio was permitted.

Copyright And Human Contribution

For a defensible release, keep a record of the material you created yourself: lyrics, melodies, arrangement decisions, recorded instruments, edits, and mixing choices. Save prompts and dated exports as production records, but do not assume a prompt by itself creates authorship under the Copyright Office’s guidance. If you register a work containing more than a minimal amount of AI-generated material, disclose that material and identify your human contribution. U.S. Copyright Office guidance

Voice Cloning, Covers, And Samples

Use a voice model only with documented consent from the person whose voice is being modeled, and follow the service’s voice-training and publishing terms. A paid plan may grant commercial use of generated audio without granting permission to impersonate a real performer.

Covers And Style References

Request an original performance rather than asking for a replica of a named singer or an existing recording. If you make a cover, clear the underlying composition and follow the distributor’s cover requirements; an AI rendition does not erase those obligations.

Samples And Reference Audio

Use your own recordings or material with a license that covers transformation and commercial release. Keep the license, consent, and source details with the project so you can show what each input was.

A Practical, Lower-Risk AI Music Workflow

  1. Define the release: Write down whether the track is personal, client, advertising, game, podcast, or commercial music before generating it.
  2. Use cleared inputs: Prepare original lyrics, your own recordings, or references whose licenses expressly allow the intended use.
  3. Prompt for originality: For example: “Create an original 90-second instrumental cue in 4/4, with a restrained piano motif, analog-style percussion, and a clear loop point. Do not imitate any named artist, recording, melody, or voice.”
  4. Add human authorship: Rewrite lyrics, record parts, edit sections, arrange stems, or mix the result so your contribution is identifiable and documented.
  5. Check the plan terms: Confirm that the plan active when you generated and downloaded the track grants the intended commercial rights, attribution status, download rights, and any restrictions on films, television, games, or client work.
  6. Disclose when required: Use platform labels or credits for realistic synthetic content, and keep an AI-use note for registration or client records.
  7. Audit before release: Check for accidental voice resemblance, copied lyrics or melodies, unlicensed samples, duplicate uploads, and metadata that could mislead listeners.

What Selected AI Music Services Say About Commercial Rights

These statements describe the vendors’ published terms and do not replace checking the current license for your account and project.

Musicful Downloaded tracks receive a non-exclusive perpetual license for content and monetization; Musicful retains ownership. Commercial use and a commercial-license certificate are stated. Keep the certificate and remember the license is non-exclusive.
Songin.ai Paid-plan music is stated to have commercial rights; free downloads are watermarked MP3 files for personal use only. Do not treat a free, watermarked download as a commercial master.
Tunee Paid subscribers receive full commercial rights; free users may use music for personal projects with attribution. Record the plan and required attribution at the time of export.
Sunp Paid plans are the stated path for commercial publishing, certificates, and repeatable project use under its current License Agreement. Read the current License Agreement before publishing.
AI Makes Song Free users can test and publish with attribution; paid plans unlock commercial rights for videos, podcasts, and games. Use the paid license when the project is monetized or client-owned.
OpenMusic AI Its site says generated tracks are royalty-free, cleared for commercial use, and supplied with a license. Download and archive the license with the final audio.

Platform Rules Can Still Block A Lawful Track

Spotify announced protections against unauthorized vocal impersonation, mass-upload spam, and duplicate tracks, and supports DDEX AI disclosures in credits. YouTube’s “inauthentic content” monetization policy targets mass-produced, repetitive, or template-based uploads rather than AI use by itself. When To Stop And Get Specific Advice

Pause a release if it relies on a recognizable person’s voice, a commercial recording, disputed reference audio, or a client contract that assigns exclusive ownership.
