Royalty-free describes the licence you receive, not automatic copyright ownership. For AI background music, you need a plan that permits your intended use, records proving that permission, and a workflow that avoids copying a recognisable artist, song or voice. In the United States, material generated entirely by AI is not copyrightable; only human-authored parts of a mixed work can be protected, and registrations must disclose more than a minimal AI contribution. What Royalty-Free Means For Background Music
Royalty-free normally means you do not pay a royalty for every view, stream or use after the licence is granted. It does not mean the track is exclusive, that you own the copyright, or that every plan allows commercial publishing. A free download may be personal-use only, watermarked, public, or restricted from Content ID claims.
- Save the downloaded file, invoice or plan record, licence certificate, prompt, date and account used.
- Check whether the licence covers your exact outlet: monetised video, podcast, game, client work, advertising, streaming or social posts.
- Check whether downloads, stems, edits, voice cloning, covers and redistribution have separate conditions.
Copyright And Disclosure Limits
A prompt alone does not make you the author of an entirely AI-generated track. Your original lyrics, arrangement, editing or other human contribution may be protectable, but the AI-generated portions are not automatically protected under the U.S. Copyright Office’s January 2025 guidance. If you register a work containing more than a minimal AI contribution, disclose the AI material and describe your contribution.
Platform rules add another layer. Spotify says vocal impersonation is allowed only when the impersonated artist authorises it, and it supports DDEX AI disclosures in credits. YouTube requires its altered-or-synthetic-content label when realistic synthetic material could be mistaken for a real person’s performance. YouTube’s inauthentic-content policy targets mass-produced, repetitive or template-based uploads rather than AI use itself.

For a game prototype, specify loop length, intensity range and instrumentation rather than a named composer: “60-second seamless instrumental loop, curious sci-fi exploration, light percussion, no lead melody, seamless bar transition.” Keep the prompt and source file so you can show how your human decisions shaped the final mix.

When To Stop And Check The Terms
Pause before publishing when a plan says “personal use,” when a free track is public or watermarked, when a voice or cover resembles a real performer, or when you need Content ID, exclusivity, client sublicensing or standalone music distribution.
