Do You Need a License for AI-Generated Music? A Creator’s Guide

Usually, you do not need a separate music license just because a track was generated with AI—but you may need permission under the generator’s terms to use, download, publish, or monetize it. That platform permission is different from copyright ownership: in the United States, the Copyright Office says material generated entirely by AI is not copyrightable, and prompts alone do not make a person its author. What “License” Means For An AI Music Track

There are two separate questions. First, does the service’s agreement let you use the track for your intended purpose, such as a monetized video, game, podcast, or client project? Second, does copyright law protect the track, or parts of it? A service can grant commercial-use permission without making a wholly AI-generated composition copyrightable.

For U.S. copyright registration, applicants must disclose and describe their human contribution when a work contains more than a minimal amount of AI-generated material. The Copyright Office says only the human-authored parts of a mixed work can be protected. U.S. Copyright Office AI report

Check These Rights Before You Publish

  • Commercial use: Confirm that the specific plan and track permit your destination and monetization model. “Royalty-free” or “commercial” wording does not, by itself, answer every question about ownership or copyright.
  • Downloads and proof: Check whether your plan lets you download the track and whether the service supplies a license or certificate. Save the track, its license, the plan details, and the date you generated it with the project.
  • Voices, covers, and samples: A generator’s commercial-use terms do not establish that you have consent to imitate a real person, use a protected recording, or make a cover. Get any required consent and check the platform’s terms for the voice, cover, or sample involved. Spotify says vocal impersonation is allowed only when the impersonated artist has authorized it. These service statements describe their own offerings; they do not establish copyright protection or permission for third-party material in a prompt, sample, or voice. Terms can vary by plan, so read the current agreement for the exact track and use.

Songin.ai Its free plan is personal-use only; paid plans are described as including full commercial rights. Free downloads are watermarked MP3 files; check the plan terms for paid downloads and uses.
Sunp Commercial use is described as available on paid plans, which are also the path to certificate access and repeatable project use under its current License Agreement. Review the license before the track leaves your workspace.

A Rights-Conscious Workflow For A Video, Game, Or App

  1. Write down the use case. Specify where the music will appear, whether the work will be monetized, and whether it is for your own channel, a client, or a company.
  2. Choose a plan only after checking its terms. Confirm commercial permission for that use, download access, and any limits on the licensee or destination. If a point is not established in the service’s terms, ask the service or choose a track with terms that clearly cover it.
  3. Prompt for original material. For example: “Create an original, instrumental background cue for a 45-second puzzle-game level: restrained electronic percussion, warm synth bass, a repeating four-note motif, no vocals, and a clean ending.” Avoid asking for a named artist’s voice, a cover, or a recreation of a known recording unless you have the necessary consent and rights.
  4. Keep a human-authored record. Save your own lyrics, melody, arrangement, edits, and project notes separately from the generated output. If you make a mixed work and seek U.S. registration, disclose AI-generated material and describe your contribution as the Copyright Office requires.
  5. Archive the evidence. Keep the generated file, prompt, account and plan details, applicable terms, and any track license or certificate together with the project. This makes it easier to answer a platform, client, or distributor question later.
  6. Review the release destination. Check its current disclosure and monetization policies, especially if the audio or accompanying video could be mistaken for a real person’s performance.

What A Commercial License Does Not Settle

A service’s license can set out what it permits you to do with a download, but the available facts do not establish that every AI-generated track receives copyright protection, that every source used to create a track was authorized, or that one service’s license satisfies every distributor or jurisdiction. For non-U.S. releases, specific samples or covers, a recognizable voice, or an important commercial project, check the relevant service and destination terms and get qualified legal guidance for your situation.
